Terms of Service
Last updated: 1 October 2026
aipixel.fun is a tool for generating images and videos with AI. Minimum age: 18. You pay with credits (an access package plus top-ups), not a subscription. The content you generate is yours — but you are responsible for what you generate and how you use it. Absolute prohibition: 18+ content depicting real, identifiable people, and any content depicting minors. Breaching these Terms results in a permanent account ban, with no refund for unused credits.
§1. Definitions
As used in these Terms of Service, the following terms mean:
Service Provider — Sparrowlabs sp. z o.o. (a Polish limited liability company), with its registered office in Warsaw, ul. Tadeusza Korzona 115/15, 03-571 Warsaw, Poland, entered in the register of entrepreneurs of the National Court Register (KRS) kept by the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register, under KRS number 0001258379, NIP (tax identification number) 5243079518, REGON (statistical number) 545417991, share capital PLN 5,000.00.
Website — the website available at aipixel.fun, together with its subpages.
Service — the services provided electronically by the Service Provider that enable the storage and organization of prompts and image/video materials (Library), local video editing (Video Studio), and the generation of images and video materials using artificial intelligence (Generate), all available through the Website.
User — a natural person using the Service who has created an Account.
Consumer — a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code, i.e. a natural person entering into a legal transaction with the Service Provider that is not directly related to their business or professional activity.
Account — an individual User account within the Service, created by signing in with a Google account (Google OAuth).
Credits — the Service's internal billing unit, purchased for a fee (Access Package / Top-up) and consumed when generating materials with AI, in accordance with §5.
User Content — any data, files, prompts (text descriptions), and materials submitted by the User to the Service, including files uploaded as reference material for generation.
Generated Content — images and video materials generated by the artificial intelligence model based on User Content (a prompt and/or reference material) within the Generate feature.
AI — the artificial intelligence model made available through a third-party API provider (Siray), used to generate images and video materials based on User Content.
§2. General Provisions
These Terms of Service set out the rules for the Service Provider's provision of services by electronic means through the Website, including the rules for entering into and terminating agreements for access to the Service and the rules for purchasing Credits.
These Terms of Service constitute the terms and conditions referred to in Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
Using the Service requires a device with internet access, an up-to-date web browser, and an active Google account.
§3. Account — Adults Only
An Account is registered exclusively by signing in with a Google account (Google OAuth).
Only persons who are at least 18 years old may use the Service. The Service is not intended for minors, regardless of the type of content generated. When first signing in, the User makes an explicit declaration of legal age — see §8 and the sign-in form. Making a false declaration of legal age constitutes a serious breach of these Terms of Service and results in the immediate, permanent suspension of the Account under §11, regardless of any legal liability the User may separately incur under applicable law.
Each User may hold only one Account. Creating multiple Accounts as the same person is not permitted.
The User is responsible for the security of access to their Account and undertakes to promptly notify the Service Provider of any suspected unauthorized access.
Registration constitutes acceptance of these Terms of Service and the Privacy Policy.
§4. Scope of Services
As part of the Service, the Service Provider makes available:
- the Library — storage of image/video files together with assigned prompts and tags; available free of charge.
- Video Studio — local video editing (trimming, cropping, subtitles, watermarking, background music, assembly) performed on the Service Provider's servers, but without AI involvement; available free of charge, at no Credit cost.
- Generate — the generation of new images and video materials by AI based on a prompt and optional reference files; a paid feature, billed in Credits in accordance with §5.
- Assets — a persistent pool of reference files for repeated use in Generate.
Access to materials marked as 18+ in the Library requires a Pro plan. The 18+ content generation feature is additionally subject to the rules described in §8.
§5. Credits and Payments
AI generation of materials is based on Credits, purchased through the Access Package (a one-time fee that unlocks access to the Generate feature together with a defined pool of Credits) and Top-ups (additional Credit packages that can be purchased at any time).
The current price list for the Access Package and Top-ups is displayed in the Service before any purchase is made. The Service Provider reserves the right to change the price list; such a change does not affect Credits already purchased.
Credits are consumed at the moment a generation task is submitted, at a cost that depends on the length and resolution of the selected material. Consumed Credits are non-refundable, regardless of whether the generation result meets the User's expectations — AI generation is probabilistic in nature and the Service Provider does not guarantee any particular result (see §12).
Payments are handled by Stripe (Stripe Payments Europe, Ltd., based in Ireland, and affiliated entities within the Stripe group) — payment takes place on a payment page hosted by Stripe; the User provides their payment card details directly to Stripe, and the Service does not store them or have access to them. An invoice for a payment made is issued at the User's request, sent to the e-mail address indicated in §15.
Unused Credits are not subject to any specific expiry period, subject to §11 (Account suspension for breach of these Terms of Service).
Prices for the Access Package and Top-ups are quoted and charged in United States Dollars (USD). The price shown before payment is the final price (the total amount payable), including VAT where applicable law requires it to be charged. The User's bank or card issuer may apply its own currency conversion rate and its own fees.
Credits are added to the Account once payment is confirmed by Stripe, usually within a few minutes of payment. If Credits do not appear in the Account within a reasonable time, the User should contact the Service Provider at the e-mail address indicated in §15.
§6. Right of Withdrawal (Consumer)
A Consumer who has entered into a distance agreement with the Service Provider for the supply of Credits has the right to withdraw from it without giving any reason within 14 days of the date the agreement was concluded, in accordance with the Polish Consumer Rights Act of 30 May 2014 — to the extent that the Credits covered by that request have not yet been used.
To exercise the right of withdrawal, the Consumer should inform the Service Provider of their decision by way of an unambiguous statement (e.g. an e-mail sent to the address indicated in §15), containing the Account e-mail address and the purchase date.
Credits constitute digital content not supplied on a tangible medium within the meaning of the Consumer Rights Act. By submitting a generation task, the User requests that performance (the use of Credits) begin before the withdrawal period expires — in accordance with Article 38(13) of the Consumer Rights Act, the right of withdrawal does not apply to Credits already used to generate material.
§7. Complaints
The User may submit complaints regarding the functioning of the Service or billing to the e-mail address indicated in §15.
A complaint should include a description of the issue being reported, the e-mail address associated with the Account, and the expected manner of resolution.
The Service Provider will review the complaint and respond within 14 days of receiving it.
A Consumer may also use out-of-court methods of handling complaints and pursuing claims, including through the county (municipal) consumer ombudsman or the Provincial Trade Inspectorates — details are available at uokik.gov.pl (the website of the Polish Office of Competition and Consumer Protection, UOKiK).
§8. Rules of Use — Prohibitions, ZERO Tolerance
By using the Service, the User undertakes not to use it to generate, store, or distribute content that:
- depicts, in a sexually explicit manner (18+), real, identifiable people (including the User themselves, other private individuals, public figures, or celebrities) — regardless of whether the User has that person's consent — as well as pornographic or sexually explicit content in general, regardless of who it depicts. This prohibition covers, in particular, generating 18+ content based on a photograph (face-swap, "bringing a photo to life," or similar) of any real, recognizable person. It is also prohibited to generate pornographic and sexually explicit content even where it depicts purely fictional characters and was entirely generated by AI.
- depicts minors (under 18 years of age) in any way that suggests sexual or erotic content — with no exceptions, regardless of whether the character is fictional, stylized, drawn, generated, or based on a real person. This also applies to content in which the depicted character's age is ambiguous but the context suggests they may be a minor.
- infringes the rights of third parties, including copyright, image rights, personal rights, or trademark rights, including generating content depicting third-party brands, logos, or protected characters in a manner that infringes their owners' rights;
- is unlawful in nature, including content that incites violence, hatred, or discrimination;
- uses another person's likeness, uploaded as a reference file, without their consent.
The above prohibitions are absolute and are not subject to any contractual exceptions. The Service Provider reserves the right to proactively review reports of violations and to cooperate with law enforcement authorities in the event of a suspected violation of laws concerning the sexual exploitation of minors. Reports of prohibited content or rights infringements may be sent to the e-mail address indicated in §15 with the subject line "Violation report"; we handle them without undue delay.
§9. Liability for User Content and Generated Content
The User bears full and sole responsibility for User Content (including prompts and reference files) and for Generated Content produced using it — including its lawfulness, the manner of its further use, publication, or distribution, and any related third-party claims.
The Service Provider provides only the technical tool that enables content generation by AI. The Service Provider does not moderate, approve, or review the content of prompts entered by Users before they are sent to the AI, and is not liable for the specific content a User chooses to generate or for how it is used, without prejudice to the Service Provider's right to respond to violations as described in §11.
The User undertakes to indemnify the Service Provider against any liability towards third parties arising from the User's generation, possession, or distribution of content that violates §8 or applicable law.
§10. Intellectual Property
All intellectual property rights to the Website, including its name, graphic marks, source code, layout, and database, belong to the Service Provider.
The copyright in Generated Content belongs to the User who initiated its creation. The Service Provider does not claim any rights to Generated Content or User Content and is not liable for its content — in accordance with §9.
The User retains full rights to User Content and grants the Service Provider a non-exclusive, royalty-free license to process it solely for the purpose and to the extent necessary to provide the Service (including transmitting it to the AI in order to generate material).
The Service Provider does not guarantee that Generated Content is free of third-party rights (e.g. that it does not resemble an existing work or trademark) — responsibility for verifying and further using Generated Content rests with the User.
§11. Account Suspension
If a User breaches these Terms of Service, in particular the prohibitions described in §8, the Service Provider has the right to immediately suspend or permanently ban the User's Account, without prior warning.
An Account ban resulting from a breach of these Terms of Service is imposed without any refund for unused Credits held in the Account at the time of the ban. This does not apply where the Account was banned due to the Service Provider's fault or without any basis under these Terms of Service.
The Service Provider reserves the right to delete User Content and Generated Content that violates §8 without notice, regardless of any decision to ban the Account.
§12. Disclaimers Regarding AI Generation
Image and video material generation is performed using third-party artificial intelligence models. The Service Provider has no control over the internal operation of these models and does not guarantee that the generation result will precisely match the User's prompt or reference files (e.g. that the generated face, clothing, or background will faithfully reproduce the reference).
The Service may refuse to carry out, or may interrupt, a generation task if the AI provider reports a violation of its own usage policies — in such a case, Credits for the failed task are refunded to the User.
§13. Service Provider's Liability
To the maximum extent permitted by applicable law, the Service Provider is not liable for: the content of User Content and Generated Content (see §9); the unavailability or malfunction of third-party services used to provide the Service (including, among others, Supabase, Vercel, the AI API provider, and the payment operator); or data loss resulting from causes beyond the Service Provider's control.
The limitations of liability referred to in this section do not exclude or limit the Service Provider's liability towards Consumers to the extent that such exclusion or limitation would be contrary to mandatory provisions of law.
§14. Changes to These Terms of Service
The Service Provider reserves the right to amend these Terms of Service for important reasons (including, among others, a change in the scope of the Service, a change in the law, or a change in the price list).
The Service Provider will notify Users of a planned amendment to these Terms of Service at least 14 days before it takes effect, by e-mail to the address associated with the Account or by a notice within the Service.
Continued use of the Service after the effective date of the amendment constitutes acceptance of the new Terms of Service.
§15. Final Provisions
These Terms of Service are governed by Polish law.
The parties will attempt to resolve any disputes arising from the use of the Service amicably. In the absence of an agreement, jurisdiction will be determined in accordance with generally applicable law.
In matters not regulated by these Terms of Service, the provisions of Polish law apply, including the Civil Code and the Consumer Rights Act.
